Is Assault an Indictable Offence in Canada?

Home >> FAQs >> Is Assault an Indictable Offence in Canada?

In Canada, assault is generally a hybrid offence  the Crown can choose to proceed by summary conviction or by indictment, depending on the severity of the incident. Simple assault (section 266 Criminal Code) is often treated summarily, while more serious forms such as assault causing bodily harm (section 267), assault with a weapon (section 267), or aggravated assault (section 268) are typically prosecuted as indictable offences carrying up to 10 or 14 years in prison.

If you are facing assault charges in Brampton or surrounding areas, an Assault Lawyer can assess the Crown’s evidence and build a strategic defence.
